Terms & Conditions of Borrowing & Liability Waiver

These Terms and Conditions form a legally binding agreement between you, hereafter called the Member and the Community DIY Library, hereafter called DIY Library. They define your rights, responsibilities, and obligations when using the DIY Library services. By tools we mean tools, items, or anything that you borrow.

These Terms and Conditions help protect the rights and interests of Members and the DIY Library. They establish guidelines for proper tool usage, safety protocols, liability limitations, and the handling of personal data. These Terms and Conditions include guidelines on maintaining tool condition, reporting damages, and addressing any concerns on safety to ensure the longevity and availability of tools and items for all Members.

These Terms and Conditions ensure that the DIY Library operates in compliance with relevant UK laws, regulations, and standards. Any legal action relating to these Terms & Conditions shall be exclusively brought in the courts in England. The DIY Library operates on the principle of sharing resources and promoting sustainability.

Acceptance of Terms

By becoming a member of the DIY Library and using our tool library services, you acknowledge that you have read, understood, and agreed to comply with the following Terms and Conditions. If you do not agree with any part of these terms, please refrain from using the DIY Library.

Your acceptance of these Terms and Conditions constitutes a legally binding agreement between a Member and the DIY Library. You agree to abide by all the terms, policies, and guidelines. The DIY Library reserves the right to update, modify, or amend these Terms and Conditions at any time. Any changes will be effective immediately upon posting the revised version on the website or notifying you via email. It is your responsibility to review the Terms and Conditions periodically to stay informed about any updates. Should any part of these Terms and Conditions become ineffective it shall not affect the remainder of this agreement or make the whole agreement void.

Your acceptance of these Terms and Conditions applies to your current and future interactions with DIY Library. If you continue to use the   DIY Library services after any modifications to the Terms and Conditions, it will indicate your ongoing acceptance of the updated terms.  Failure to comply with any of the Terms and Conditions may result in the termination or suspension of your membership and right to borrow tools or items.

By accepting these Terms and Conditions, you confirm that you have read and understood the provisions contained within and that you agree to be bound by them. If you have any questions or concerns regarding these terms, please contact us for further assistance.

Membership

Membership is open to all residents over 18 years of age. and Named Members MUST BE RESIDENT IN THE SAME HOUSEHOLD and over 18 years of age.

Tool Borrowing and Responsibilities

1.     The tools available for borrowing from the DIY Library are intended for community use and should only be used for their intended purposes and in the spirit intended for the ongoing success of the project.

2.     Tools may be borrowed for a maximum period of upto 14 days (extensions to this period can be requested).

3.     Members are responsible for inspecting the tools
prior to borrowing them and reporting any existing damage or defects to the library volunteers.

4.     Members are responsible for the proper and safe use of the borrowed tools.

5.     Tools should not be loaned, rented, or sublet to others, or used for a professional task.

6.     Members are responsible for returning the tools in the same condition as they were borrowed, except for normal wear and tear.

7.     Members must clean the tools after use and return them in a usable condition.

8.     Members should promptly report any damage or loss of tools to the library volunteers.

Late Returns and Donations

1.     Members should return the tools by the agreed return date.

2.     If the tools are not returned by the agreed return date, the borrower will be expected to make a late return donation of £1 per trading cycle until the tools are returned.

3.     The late return donation will go towards supporting the maintenance and acquisition of tools for the library.

4.     The DIY Library reserves the right to refuse further tool borrowing  privileges to Members with excessive late returns or unpaid late return donations

5.     Members are responsible for the safekeeping of the tools or items while in their possession.

6.     If a tool is lost, stolen, or damaged beyond normal wear and tear while in the Members possession, the Member will be responsible for the cost of repair or replacement.

7.     The Members agrees to pay the DIY library the current market value of the tool or replace it with an item in equivalent  condition, if it is lost or damaged beyond repair.

8.     The DIY Library suggest that the Member take a picture of the borrowed item before leaving.

Liability Waiver for the borrowing of Tools and Items

I understand that the DIY Library allows members to borrow various tools, including but not limited to electrical tools such as hedge trimmers and drills, for personal use, free of charge. In consideration of being granted access to and use of these tools, I willingly and voluntarily agree to the following:

Assumption of Risk

I understand and acknowledge that the use of tools, particularly electrical tools, carries inherent risks, including the risk of personal injury, property damage, and even death. I hereby assume all such risks associated with the use of the tools borrowed from the DIY Library. I accept full responsibility for my own safety and others while using these tools and items.

Release and Waiver of Liability

To the maximum extent permitted under UK law, I release and discharge the DIY Library, its volunteers, and affiliated organisations from any and all liability, claims, demands, actions, or causes of action arising out of or in connection with my use of the borrowed tools. This includes, but is not limited to, any injuries, damages, losses, or expenses incurred as a result of the use, misuse, or condition of the tools, whether caused by the DIY Library’s negligence or otherwise.

Indemnification

I agree to indemnify and hold harmless the DIY Library, its volunteers, and affiliated organisations from any and all claims, demands, actions, or causes of action, including reasonable legal fees, arising out of or in connection with my use of the borrowed tools. I understand that this indemnification applies to any claims made by third parties, including but not limited to my family members, guests, or other individuals who may be affected by my use of the tools.

Safety Precautions and Proper Use

I acknowledge that it is my responsibility to exercise caution, follow proper safety procedures, and use the tools in accordance with their intended purpose and manufacturer’s instructions if available. I agree to inspect the tools before each use and report any defects or malfunctions to the DIY Library promptly. I understand that failure to adhere to safety guidelines or improper use of the tools may result in injury or damage for which I assume full responsibility.


Ensure that you use all relevant safety equipment required.

Ensure that you refer to the instruction manual if available, relevant manufacturers website, or ask for a demonstration before using any equipment,
or even ask for a relevant YouTube Clip.

I hereby understand and agree to the DIY Library holding my details which will only be used for the purposes of borrowing, volunteering or communication. My details will not be shared with any third parties other than authorities in cases of law or safety.

When checking the tick-box on the Tool Enquiry Form, I acknowledge that I am agreeing to the whole document and have READ and UNDERSTOOD these Terms of Borrowing & it’s integrated Liability Waiver, and I voluntarily and knowingly accept all the terms and conditions.
